2026 Supreme(Online)(AP) 15709

IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
Y. Lakshmana Rao, J
Nissankarao Durga Prasad – Appellant
Versus
The State of Andhra Pradesh – Respondent
CRIMINAL PETITION NO: 3148/2024|CRIMINAL PETITION NO: 1553/2026

Advocates:
For the Appellants/Petitioners: P Vivek
For the Respondents: Grandhi Priyanka, Public Prosecutor (AP)

The High Court may exercise its inherent power under Section 482 CrPC or Section 528 BNSS to quash non-compoundable criminal proceedings in matrimonial or family disputes if a voluntary settlement is reached, the victim is an adult, and continuation of trial would be futile.

Headnote:The petitioners filed petitions under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to quash proceedings in P.R.C.No.118 of 2022 for alleged offences under Sections 417, 376(2)(n), and 506 read with 34 of the Indian Penal Code, 1860. The de-facto complainant and the accused reached an amicable settlement through the intervention of elders, and the complainant, being an adult, expressed a voluntary desire not to pursue the criminal proceedings. The court found the compromise to be genuine and not vitiated by coercion. The primary issue is whether the High Court can exercise its inherent jurisdiction to quash non-compoundable criminal proceedings based on a settlement. The court reasoned that while heinous crimes cannot be quashed, offences arising out of matrimonial or family disputes where the wrong is private and the victim is an adult may be quashed if continuation of proceedings would be "futile and oppressive" and would not serve the ends of justice, following the guidelines established by the Apex Court. Accordingly, the Criminal Petitions are allowed.
