Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring action of the respondents more particularly Respondent No. 5 in appointing the one V. Krishna who belongs to (S.C.) disadvantage group as Chairman of school management committee in 5^th Respondent school without following the rules prescribed in the notification dated 01.08.2024 issued by the 2nd Respondent for conducting elections for which I had submitted a representation to the authorities on 21.04.2025 against which no action has been initiated till today which is highly illegal, arbitrary and violation of Article 14 and 21 of the Constitution of India and in violation to the principals of natural justice and consequently dismissed the 6^th respondent from the post of chairman of school management committee in 5^th respondent school and pass such other order.

IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to appoint a candidate belongs to weaker section for the post of Chairman by dismissing the appointment of the said V. Krishna who belongs to (S.C.) disadvantage group from the said post by notification issued by the 2^nd respondent dated 01.08.2024 pending disposal of the main Writ petition and pass such other order.

HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.17467 of 2025

ORDER:

1. The present Writ Petition is filed questioning the action of Respondent No.5 in appointing one V. Krishna as Chairman of School Management Committee in Respondent No.5-School vide Notification dated 01.08.2024 issued by Respondent No.2 without following due process of law, as illegal and arbitrary.

2. At the time of hearing, Sri Pathi Siva Prasad, learned counsel for the Petitioner submits that he had given ‘No Objection Vakalat’ to the Petitioner on 11.02.2025 and returned the entire case record to him. A Memo dated 05.03.2026 to that effect was filed by the Petitioner vide WPUSR 27967 of 2024.

3. Since there is no alternative arrangement made by the Petitioner, the Writ Petition is closed, leaving it open to the Petitioner to re-agitate the issue by engaging another counsel after filing the restoration application.

4. No order as to costs.

5. As a sequel, pending applications, if any, shall stand closed.
