Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an order direction or writ more particualrly one in the nature of writ of mandamus or any other appropriate writ declare the proceedings Memo No.SE/O/NLR/PO/JAO/.Estt/SA/D.No.287/13 dated 15.2.2013 issued by the Respondents retiring the petitioner from service on attaining the age of 58 years is illegal, and arbitrary,(ii) declare that the petitioner is entitled to be continued in service up to the age of 60 yearts and (iii) direct the respondents to continue the petitioner upto 30.6.2015 with all consequential monetary and other benefits and pass IA NO: 1 OF 2013(WPMP 22936 OF 2013 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to continue the petitioner as Record Assistant by suspending the proceedings Memo No.SE/O/NLR/PO/JAO/Estt/SA/D.No.287/13 dated 15.2.2013 issued by the respondent and pass Counsel for the Petitioner:

ORDER:

1. The petitioner has sought to continue in service up to the age of 60 years and has also sought to declare the proceeding dated 15.02.2013 issued by the respondents, retiring the petitioner from service on attaining the age of

58 years, as illegal.

2. This court, vide order dated 03.07.2013, considered the continuation of another employee in service till he attained the age of 60 years and, accordingly, directed the respondents to continue the petitioner in service beyond 03.06.2013 till he attains the age of 60 years or till such time the said order is modified or vacated. It was also observed that, merely on account of the pendency of the writ petition, other benefits such as payment of wages and terminal benefits shall not be withheld.

3. On account of the efflux of time, the petitioner has also attained the age of superannuation. By an order of this Court, the respondents were also directed to release the service benefits.

4. Accordingly, the present writ petition stands closed, in terms of the interim order granted earlier. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed.
