2026:APHC:16271 The Court made the following ORDER:

1. This Writ Petition is filed under Article 226 of the Constitution of

India seeking the following relief:

“to issue a writ, order or direction more in .the nature of Writ of Mandamus by declaring the inaction of the respondents in releasing and paying the retirement benefits of the petitioner i.e., Gratuity (DCRG) and Encashment of Leave salary (EL) to a tune of Rs.20,05,943/-, even though the petitioner retired from service on 30.06.2025, despite the amounts were ordered to be released by the district Audit Officer, State Audit Mangalagiri vide PPO No. M.Corp/VSP/2491/SP/2025/12-08-2025 Dated 12.08.2025 and the bills are lying with 2nd and 3rd respondent's office for want of permission from the 1^st respondent to effect payments which is illegal, arbitrary, capricious, and contrary to the rules besides violation of Article 21 of the constitution of India and consequently direct the respondents forthwith to release the Gratuity (DCRG) and Encashment of Leave salary (EL) to a tune of Rs. 20,05,943/-, to the petitioner along with admissible

rate of interest and to pass…”

2. Heard the learned counsel for the petitioner and the learned

Government Pleader for the respondents.

3. The grievance of the petitioner is that the respondents have not released and paid the retirement benefits due to the petitioner, namely Gratuity (DCRG) and Encashment of Leave Salary (EL), amounting to a total sum of Rs.20,05,943/-, even though the petitioner retired from service

on 30.06.2025.

4. The learned counsel for the petitioner submits that the 3^rd respondent has already forwarded the necessary proposals to the 2^nd

2026:APHC:16271 respondent for release of the petitioner’s retirement benefits, but the 2 nd

respondent has not taken steps to release the same. Hence the writ

petition.

5. On the other hand, the learned Government Pleader for the respondents, on instructions, submits that the matter has already been processed and a token number has also been generated for release of the

said retirement benefits.

6. Considering the submissions made by the learned counsel appearing on either side, and without going into the merits of the case, this Court deems it appropriate to dispose of the writ petition with a direction to the respondents, more particularly the 2^nd respondent, to release the retirement benefits due to the petitioner, namely Gratuity (DCRG) and Encashment of Leave Salary (EL), within a period of three (03) months

from the date of receipt of a copy of this order.

7. Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ

petition shall stand closed.
