Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of Respondents in appointing the 5th Respondent as Anganwadi Worker of Gondireddipalli Village, Rapthadu Mandal, Ananthapuram District, as illegal, arbitrary and unconstitutional and to consequently direct the Respondents to forthwith re-consider the case of petitioner for appointment to the said post keeping in view her educational qualification and merit; Award costs and pass IA NO: 1 OF 2013(WPMP 43015 OF 2013 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased issue interim directions to the Respondents to forthwith stop all further proceedings relating to appointment of Anwanwadi Worker in respect of Gondireddipalli Village, Rapthadu Mandal, Ananthapuram District, pending disposal of W P No. of 2013 and pass Counsel for the Petitioner:

ORDER:
The petitioner is challenging the appointment of 5th respondent as Anganwadi worker. The case of the petitioner is that the petitioner applied for the post of Anganwadi worker and the petitioner also attended interviews conducted by respondents Nos.3 and 4. Respondent Nos.1 to 4 have selected the 5th respondent, though the 5th respondent has studied upto SSC only, whereas the petitioner had completed graduation. The petitioner claims that she is more qualified than the 5th respondent and ought to have been appointed as an Anganwadi worker. It is also stated in the affidavit that the 5th respondent had secured 48.17 marks whereas the petitioner has awarded
31.83 marks.
2. The learned Assistant Government Pleader appearing for respondent Nos.1 to 4 states that the 3rd respondent has filed a counter and it is stated in the counter that the petitioner admittedly secured 31.83 marks in the overall merit and the 5th respondent secured 48.17 marks in the overall merit. Considering the recommendation of the selection committee, the
5th respondent was selected as Anganwadi worker.
3. Considering the submission, no grounds are made out by the petitioner for interfering with the selection process. More so, when it is admitted that the 5th respondent was awarded more marks in the overall merit and stood first for being considered for appointment.
4. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
