The Court made the following:

COMMON JUDGMENT:

1. This appeal is filed under section 173 of the Motor Vehicles Act, 1988 against the award and the decree dated 01.08.2006 in M.V.O.P.No.170 of 2000 on the file of the Court of the Motor Accidents Claims Tribunal-cum- District Judge, Guntur.

2. The cross objection is filed under Rule 22, Order XLI of C.P.C.

3. Since the learned counsel for the appellants passed away, as per the representation made across the Bench, on 05.03.2021, this Court directed notice to the appellants.

4. As per the office note, the notice sent to the appellant No.1 who is also representing the other appellants, was returned unserved with the endorsement “out of station”. Since no other address is available, the service of notice is deemed to be sufficient.

5. As there was no representation for either side on 04.02.2022, the Registry was directed to post the matter under the caption „for dismissal‟.

Even today, there is no representation for the appellants.

6. Hence, the motor accident civil miscellaneous appeal is dismissed.

7. Since there is no representation for the respondent No.1 who filed the cross objections, the cross objection petition is also dismissed.

Interim orders granted earlier, if any, shall stand vacated. Pending miscellaneous applications, if any, shall stand closed.
