Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, direction, order or orders more particularly one in the nature of Writ of Mandamus declaring the action of the respondent 2 in granting of the quarry lease in favour of the 6th Respondent for colour granite in Sy.No.
531 of Velpumadugu village, Vidapanakal mandal Anantapur District over an extant of 10.00 Hectors vide proceedings No.47921/R4:1/2008, dated 1409-2012 and its consequential order of execution of quarry le5sed deed vide proceedings No. 6037/Q2/CG/2008, dt.20-02-2013 of the Asst. Director of Mines & Geology, Anantapuram as bad and illegal, arbitrary and voilative of Art 14,19 and 21 of the Constitution of India and deprivation of right to live and causing ecological imbalance, blockade of water sources, damaging the adjacent ancient Lord Chenakesava Swamy Temple and Sunkulamma Temple, houses, agricultural fields, roads, electrical lines and hazards to the villagers due to their irregular heavy blasting operations adjacent to the village human habitation without obtaining any EC Clearance certificate from the pollution control board and violating the distance stipulated by the Hon'ble Supreme Court of India in Mohd.Haroon Ansari and another Vs District Collector Ranga Reddy District A.P and others reported in 2004 (1) SCC 491 wherein held that " the distance of 1 KM is safe distance between the site of the quarry leases and the residential localities or GLSR or the lake and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case.
IA NO: 1 OF 2016(WPMP 14603 OF 2016 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the 6th Respondent not operate the quarry lease held by him for colour granite in an extant of 10.000 Hectors .in Sy.No.531 of Velpumadugu village, Vidapanakal mandal Anantapur District pending disposal of the above writ petition and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case. .
