Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue order or direction more particularly one in the nature of Writ of MANDAMUS declaring the action of the respondents in not paying the bills raised by the Petitioner for supply of Material as per the Work Orders for an amount of Rs.99,880/- after completion of the work is illegal, arbitrary and unconstitutional and consequently direct the respondent authorities to pay the Bills amount of Rs.99,880/- along with interest @ 12 PERCENT per annum in the interest of justice and pass Counsel for the Petitioner:

ORDER:

Aggrieved by the non-payment of the bills raised by the petitioner for the supply of materials pursuant to various Work Orders, amounting to a total sum of Rs. 99,880/-, even after completion of the works, the present Writ Petition has been filed.

2. Heard Sri K. Ananda Rao, learned counsel representing Sri M.P.V.N.V. Sastry, learned counsel for the petitioner, and Sri Satish Kumar, learned Assistant Government Pleader for Irrigation.

3. Learned counsel for the petitioner submitted that the petitioner supplied materials on rent pursuant to various Work Orders. After supplying the materials, the petitioner raised several bills towards hire charges under the respective Work Orders. Thus, in total, the petitioner is entitled to receive an amount of Rs. 99,880/-.

4. Learned counsel further submitted that all the works have been completed; however, the Government has not paid the due amounts so far, and no reasons have been communicated for such non-payment. The delay on the part of the Government in settling the bills is unjust and arbitrary.

5. The learned Assistant Government Pleader for Irrigation, on the counter affidavit of the 3^rd respondent, submitted that the respondent authorities have admitted the petitioner’s claim and are willing to pay the entitled amount, i.e., Rs.

99,880/-, and sought some time for making such payment.

6. To the said submission, learned counsel for the petitioner reported no objection.

7. Taking into consideration the submissions of both the learned counsel and the contents of the counter affidavit, and as the respondent authorities are ready to pay the admitted amount to the petitioner, this Court is inclined to dispose of the writ petition with the following direction:

“The respondents are directed to release the legally admitted/entitled amount to the petitioner, i.e., Rs. 99,880/-, at the earliest, at any rate, within a period of ten (10) weeks from the date of receipt of a copy of this order.”

8. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications, pending if any, shall stand closed.
