A writ petition may be dismissed as withdrawn when the petitioner submits that the purpose of the filing has been served.

Headnote:The petitioner filed a writ petition under Article 226 of the Constitution of India seeking a writ of mandamus to direct the execution of warrants issued by a District Consumer Redressal Forum, contending that the non-execution of said warrants was arbitrary and illegal. The court examined the submission of the petitioner's counsel who stated that the purpose of filing the writ petition had been served, thereby rendering the prayer for relief unnecessary. The Writ Petition is dismissed as withdrawn.

The Court made the following:

ORDER:

The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-

“…to issue an appropriate Writ order or direction more particularly one in the nature of Writ of Mandamus declaring in not executing the Warrants issued by the Honble District Consumer Redressal Forum Guntur in E.A.No.106/2023 in C.C.No.206/2022 highly arbitrary illegal and consequently direct the 2nd respondent to execute the Warrants issued by the Honble District Consumer Redressal Forum Guntur against the 3rd respondent and pass such other order(s)…”

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

3. Sri M. Kesava Rao, learned counsel for the Petitioner, submits that the purpose of filing the Writ Petition has been served. Hence, the Writ Petition may be dismissed as withdrawn.

4. In view of the above, the Writ Petition is dismissed as withdrawn. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
