Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents not to appoint any candidate as Anganavadi worker in respect of Settur Village and Mandal of Anantapur District in the interest of justice and to pass

The Court made the following:

ORDER:

The petitioner is aggrieved by the appointment of the 5th respondent as Anganvadi worker. It is the case of the petitioner that the petitioner secured more marks when compared to the 5th respondent in the 10th class examinations. The petitioner states in the affidavit that respondent Nos.1 to 4 have erred in selecting the 5th respondent as Anganvadi worker though the 5th respondent is less meritorious as compared to the petitioner.

The learned Assistant Government Pleader appearing for respondent Nos.1 to 4 submits that the 2nd respondent has filed a detailed counter and that the selection committee has preferred the 5th respondent as a suitable candidate. It is further submitted that selection of Anganvadi worker is not solely based on the 10th class marks obtained. Due weightage was given to all candidates, who secured more marks in the 10th class examination. However the selection committee has awarded marks for other criteria as well and in overall merit the 5th respondent stood selected. Considering the submissions, no further orders are required.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
