Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue order or direction, more particularly, one in the nature of Writ of Mandamus, declaring the action of the Respondent No.2, in not Renewing the Arms Licence inspite of submitting Renewal application on 19-08-2021Under Section 15 of Arms Act 1959, as illegal, arbitrary, violation of Principles of Natural Justice and violation of Section-3 and Section-15 of the Arms Act, 1959, and consequently direct the Respondents to Renewing the Arms licence, and pass
The Court made the following:
ORDER:
This Writ Petition has been filed seeking to declare the action of respondents in not renewing the Arms Licence of petitioner inspite of submitting renewal application on 19.08.2021 under Section 15 of Arms Act, 1959 as illegal and arbitrary and consequently direct the respondents to renew the Arms Licence of petitioner.
2. Learned counsel for the petitioner submits that cause in the present Writ Petition does not survive and the matter has become infructuous.
3. Recording the said submission, the Writ Petition is dismissed as infructuous. No order as to costs.
4. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed.
