The Court made the following:
ORDER
The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue a writ of mandamus or any other appropriate writ order or direction declaring the inaction of the respondents2 and 3 in not conducting proper investigation into the death of the petitioners son and in conducting a sham postmortem as illegal and unconstitutional and consequently direct the respondent 2 and 3 to conduct a fresh fair and independent enquiry by a competent authority and to take appropriate criminal and departmental action against all persons who are responsible….”
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader.
3. As seen from the record, the FIR was registered at Kusumanchi in Khammam District as Crime No. 125 of 2024 on 24.06.2024. The deceased, by name LakkanaBharath Sai, died in Guntur. Therefore, the Medical Officer of Government General Hospital, Guntur, conducted autopsy on the cadaver of LakkanaBharath Sai. It appears that the autopsy proceedings were transferred to Kusumanchi Police Station on the point of jurisdiction.
4. Considering the entire facts and circumstances of the case, the Writ Petition is disposed of, leaving it open to the petitioner to work out his remedies before the High Court of Telangana in accordance with law.
5. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, Miscellaneous petitions, if any pending, shall stand closed.
