JUDGMENT:

It is represented that learned counsel for the respondents filed a memo dated 16.102.204 informing about the death of 1^st and 2^nd respondents. The 1^st respondent died on 29.12.2011 and the 2^nd respondent died on

19.05.2012.

2. It seems that more than eleven years back both the respondents have died but so far appellant has not taken any steps to implead the legal representatives of the respondents. As both the respondents died, this Court is of the view that the Appeal is liable to be dismissed as abated.

3. Accordingly, this Second Appeal is dismissed as abated. There shall be no order as to costs.

Consequently, miscellaneous petitions pending if any, shall stand closed.
