18.06.2013.

2. The petitioner applied for appointment to the post of Trained Graduate Teacher (Hindi) under Ex-Service men category Zone-I, AP. In this regard, the petitioner filed WP.No.15488 of 2013 before this Court and this Court on

12.06.2013 passed the following order ;

This Writ Petition can be disposed of, inasmuch as the learned Additional Advocate General, who has accepted notice on behalf of the respondents, has secured detailed instructions in the matter and made his submissions.

The writ petitioner, an Ex-serviceman, applied for the post of Trained Graduate Teacher (Hindi) against one of the posts reserved for Ex-serviceman. He appeared for the selection process and he has been arrayed at serial No. 3 in the merit list. The first candidate in the merit list has already been intimated of his selection, but however, he did not accept the same and turn up for counselling process. Therefore, the process is initiated to select the second meritorious candidate and in case, he also does not accept, the respondents would surely consider the case of the petitioner being the next meritorious candidate. On the other hand, if the merit ranker No. 2 accepts the position, since there is only one vacancy available in this quota in zone-II, the writ petitioner cannot have any grievance in his non-selection.

With this, the Writ Petition stands disposed of. No costs.

Consequently, the miscellaneous applications, if any shall also stand disposed of.

3. In pursuance of the orders passed by this Court in the above writ petition, the petitioner made representation dated 18.06.2013. The learned Government Pleader for School Education submits that the petitioner was placed at S.No.3 in the order of merit and the first candidate who secured the highest marks did not opt for joining and the candidate was placed at second in the seniority list has opted for joining. There was only one vacancy for the post of Ex-service men quota. As such the petitioner’s case was not considered. The learned Government Pleader has also placed on record the details of marks secured and the marks assigned to the petitioner and the other two to listed candidates.

4. Considering the submissions of the learned Government Pleader that the petitioner secured 39.53 marks and placed at S.No.3 with 954 rank, however, the candidate placed at S.No.2 who secured 48.93 marks and placed at 881 rank had adopted for job.

5. By recording the same, no further orders need to be passed to direct the respondents to appoint the petitioner in the present writ petition.

6. With these observations, the present writ petition is dismissed without costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
