Heard the learned counsel for the petitioner.

1. The petitioner is challenging the appointment of Respondent No.5 as the Anganwadi worker at the Vakadaripeta II Anganwadi Center and seeks direction to the respondents to issue a fresh notification.

2. The learned counsel for the petitioner submits that the petitioner applied for the post of Anganwadi worker pursuant to the notification issued by the respondents in the year 2011. However, Respondent No. 5, who is a non-local candidate, was appointed to the post. It is further submitted that the said notification explicitly required that the appointee must be a local candidate from the village. It is specifically mentioned that non-local candidates should not be selected, even if they possess higher educational qualifications.

3. The counter affidavit filed by the 3rd respondent, wherein it is stated that, the 5th respondent also resides within the same Gram Panchayat and there was no violation of any rule, provision, or regulation governing the appointment of Anganwadi workers. Along with the counter affidavit, the respondents have included a copy of the final selection committee's report, which clearly indicates that the 5th respondent secured more marks than the petitioner. Therefore, the selection of the 5th respondent cannot be disputed by the petitioner. The selection committee carefully considered the applications received, scrutinized them, conducted further assessments of the candidates, and subsequently issued the appointment orders. That a part, the 5th respondent is discharging her duties as an Anganwadi worker since the date of her appointment. As such, no further orders are required in the present writ petition. Hence, the matter has become infructuous.

Accordingly, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
