The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“……to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declare the action of the respondent in not considering the candidature of the petitioner for promotion to the post of Deputy Executive Engineer in R & B Department on mere pendency of Charge Memo vide Memo.No.4224/VC(3)/2015-3 dated 28-10-2024 (in which incident pertains to the year 2014-15), issued by the 2nd respondent, denial of promotion is illegal, arbitrary, whimsical and in violation of Principles of Natural Justice and contrary to the order of this Hon’ble Court passed in W.P.No.14326 of 2021 dated 13-09-2024, consequently direct the respondents to consider the candidature of the petitioner for promotion to the post of Deputy Executive Engineer without reference to the memo vide Memo.No.4224/VC(3)/2015-3 dated 28-10-2024, in terms of G.O.Ms.No.257 dated 10-06-1999……”
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for the respondents.

Today, when the matter is taken up for hearing, it is conjointly submitted by the learned counsel for the petitioner and learned Assistant Government Pleader for the respondents that the issue involved in this writ petition is squarely covered by the order of this Court in Writ Petition 4. In view of the submissions made by both the petitioner’s counsel and learned Assistant Government Pleader, this Writ Petition is disposed of, at the stage of admission, in terms of the above said Order in Writ Petition No.25098 of 2024, dated 06.11.2024. There shall be no order as to costs. 5. As a sequel, Interlocutory Applications pending, if any, shall stand closed.
