ORDER:
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A2, A3 and A5, seeking bail, in Crime No.785/2024 of Proddatur Rural Police Station, Kadapa District.
2. A case has been registered against the petitioners and others initially for the offence under Sections 118(1) read with 3(5) of B.N.S and later police added Section 109 of B.N.S.
3. The case of the prosecution is that:
On 11.12.2024, at about 6.00pm, A1 along with other accused attacked the defacto complainant. A1 dealt a blow with iron rod and caused bleeding injury on the head of the defacto complainant. A2 to A5 pelted stones on the defacto complainant and caused dumb injuries all over his body. Wife of the defacto complainant witnessed the same and went to rescue, then the A6 caught the tuft and dragged and beat with hands and on witnessing the same, one Venkataramana tried to rescue the defacto complainant and his wife and all the accused were beat him also with stones caused dumb injuries on his right flank and later the complainant went to Government hospital, Proddatur for treatment. Later on 14.12.2024, the petitioners were arrested and were got remanded to judicial custody.
4. Heard. Perused the record.
5. Learned Assistant Public Prosecutor submits that major part of the investigation is completed except filing of charge sheet.
6. On a perusal of material available on the record goes to show that there were disputes among the family members. In connection with that, on the date of incident, petitioners herein are alleged to have beat the defacto complainant with iron rods. The petitioners were arrested on 14.12.2024 and since then they are languishing in jail. Police have not completed the investigation and not filed charge sheet.
7. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners herein, on the following conditions.
(i) The petitioners/A2, A3 and A5 herein shall be released on their executing a personal bond for Rs.10,000/- (Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the II Additional Judicial First Class Magistrate, Proddatur;
(ii) On release, the petitioners shall appear before the Station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet.
8. Accordingly, the Criminal Petition is allowed.
