THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CRIMINAL PETITION No.94 of 2025

ORDER:

1. This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita (in short BNSS) by the petitioner/A2 seeking anticipatory bail.

2. The petitioner is accused No.2 in FIR No.121 of 2024 of the Police Station; Thavanampalle, Chittoor District.

3. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State.

3. The allegation of the de-facto complainant is that this petitioner/A2 and A1 caused injuries to the de-facto complainant. A1 stabbed with a knife and this petitioner/A2 allegedly caught hold of de facto complainant. A1 is the father de facto complainant.

4. Learned counsel appearing for the petitioner would submit that there are land disputes in between the de facto complainant and A1, who are arguing over the same property.

5. As seen from the record, there are family disputes amongst the parties. The injured is none other than the son of A1. Keeping in view that there are land disputes, delay in lodging the complaint, no specific overt acts attributed to this petitioner with regard to injuring de facto complainant though his presence is mentioned in the complaint and also accused No.1 was granted bail by this Court vide Crl.P.No.9219 of 2024, the petitioner can be granted the relief of anticipatory bail, subject to the following conditions:-

i. The petitioner/accused No.2 is directed to surrender before the Station House Officer, PS; Thavanampalle, Chittoor District, on or before 27.01.2025. Upon such surrender, the said Station House Officer shall release the petitioner on bail, on his executing a self-bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to his satisfaction.

ii. The petitioner shall appear before the concerned SHO on 1st Sunday and 3rd Sunday of every month between 10.00 AM and 1.00 PM for a period of three months or till filing of the charge sheet, whichever is earlier. Additionally, the petitioner shall make himself available for the judicial process as and when required, except for leave of the Court.

iii. The petitioner shall abide by the other conditions stipulated in 482 (2) Bharatiya Nagarik Suraksha Sanhitha, 2023 shall co- operate with the Investigating Officer in investigating the case.

iv. In case the petitioner commits breach of any of the conditions, the bail is liable to be cancelled at the instance of the prosecution.

6. Accordingly, this Criminal Petition is allowed.
