Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 2 to 4 in issuing notification in Memo N0.51/A2/DW and CDA/ ANMYA, DATED 23.12.2024 and not consider the my request for appointment of anganawadi worker (AWW) without considering my certificates and declare the same as illegal, irregular and irrational and violative of principles of natural justice, contrary to the settled principles of service jurisprudence and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents to appoint me as Anganwadi Worker in the said Anganwadi Center and pass such IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondents 2 to 4 to appoint me as Anganwadi Worker in the said Anganwadi Center, pending disposal of the main writ petition and pass Counsel for the Petitioner:

The above writ petition is filed to declare the action of respondents 2 to

4 in not considering the petitioner’s candidature for appointment of Anganwadi Worker, as illegal and arbitrary.

2. Heard Sri A.L.A. Chandra Sekhar Yadav, learned counsel for the petitioner and Sri Srinivas, learned Assistant Government Pleader for Endowments appeared for the respondents.

3. Respondent No.2 issued notification vide Memo No.51/A2/DW&CDA/ ANMYA, dated 23.12.2024 (Ex.P1), calling for applications from the eligible candidates for appointment of Anganwadi Worker, Anganwadi Helper and Mini Anganwadi Worker. In the notification, it was mentioned that the candidate should have crossed 21 years of age on 01.07.2022 and should not have exceeded 35 years. The petitioner is aged about 20 years and does not meet the qualification prescribed in the notification regarding age requirement.

4. Since the petitioner is not even qualified to apply for the post, a non- consideration of the petitioner’s case for appointment does not arise. Hence, this Court does not find any merit in the writ petition and is liable to be dismissed.

5. Given the facts and circumstances of the case, the Writ Petition is dismissed. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
