This Criminal Petition under Section 438 of Cr.P.C., is filed seeking to grant anticipatory bail to the petitioner herein/accused No.6 pertaining to Crime No.76 of 2024 of Special Enforcement Bureau Police Station, Ponnur, Guntur District, registered for the offence punishable under Sections 34(a)(1) of A.P Excise (Amendment) Act

2020.

2. Heard Sri Daggubati Venkateswara Rao, learned counsel for the petitioner and learned Assistant Public Prosecutor for the Respondent-

State.

3. Heard both sides. Perused the record.

4. The FIR in this case was registered on 04.04.2024. After due investigation, investing officer cited 10 witnesses and arrested 6 accused and filed charge sheet before Special Judicial I Class Magistrate for Prohibition & Excise, Guntur, where it was registered as C.C.4377 of 2024 and in the charge sheet, there is an allegation that A6 has been absconded as per the cause title, who works at army canteen at New Delhi and his native place at Varagani Village, Pedanandipadu Mandal, Guntur District, Andhra Pradesh and in the circumstances of the case of prosecution the petitioner is involved in illegal transportation of large quantity of liquor bottles the other accused involved in this alleged crime were already released on regular bail. Since the petitioner works in army and he is allowed to point out that he was participating in the legal process, no reason to have him in custody, after investigation would complete. Hence, prayer is granted.

5. In the result, the criminal petition is allowed with the following conditions:

i. In the event of the arrest, the petitioner/A6 herein shall be released on bail on their executing a personal bond for Rs.10,000/- (Rupees ten thousand only) each with two (02) sureties for a like sum each to the satisfaction of the arresting police officials;

ii. After release, the petitioners shall appear before the Station House Officer concerned, on 1st and 15th of every month between

10.00am to 01.00pm for a period of three months; and iii. That the petitioners are directed not to hamper the investigation and tamper with the prosecution witnesses and they shall not indulge in similar type of offences.

Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
