The Court made the following:

Heard learned counsel for the petitioner and learned counsel for the respondents.

2. The petitioner is challenging the in action on the part of the respondents in considering his case for promotion to the post of Joint Secretary though he is the senior most Deputy Secretary. The Writ Petition was filed when the petitioner was on the verge of attaining the age of superannuation.

3. In Government of West Bengal and others vs Dr.Amal Satpathi and others the Hon’ble Supreme Court held that the grant of promotion to an employee who was superannuated before his promotion cannot be granted. The petitioner has also attained the age of superannuation and his case for grant of any relief directing promotion after superannuation cannot be granted.

4. Considering the same, the Writ Petition is dismissed. without costs.

Pending miscellaneous petitions, if any, shall stands closed.
