ORDER:

The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:

"….to issue a writ order or direction more particularly one in the nature of writ of MANDAMUS declaring the action of the respondents in not releasing the amount of Rs.79,088/- (Seventy Nine Thousand Eighty-Eight Rupees) to the petitioner even after the timely execution of the work “Construction of embankment at newly constructed Grama Sachivalayam and RBK complex at N.P. Kunta Habitation, N.P.Kunta Mandal” sanctioned vide Progs.No.65/KDR Const/GGMP-HIW/2022-23 Dated: 15.11.2023 as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and also opposed to the settled principles of law, and consequently direct the respondents to forthwith pay the total net amount of Rs.79,088/- (Seventy Nine Thousand Eighty- Eight Rupees) to the petitioner even after timely execution of the work “Construction of embankment at newly constructed Grama Sachivalayam and RBK complex at N.P. Kunta habitation, N.P.Kunta Mandal” along with 12% interest per annum and pass such other orders……."

2. Learned Government Pleader filed a letter, vide Rc.No.28/A2/2022 dated 06.01.2025, addressed by the Executive Engineer, PRI Division, Penukonda, Sri Satya Sai District, to the Government Pleader Office. As seen from the letter, it transpires that out of total work done by the petitioner for Rs.98,512/-, an amount of Rs.19,424/- deducted towards statutory recoveries and the net amount that is payable is Rs.79,088/- and the bill was uploaded in NIDHI Portal vide Bill No.2023-9008338 and bill is waiting for fund clearance.

3. As the respondents are not disputing the execution of the work and amount due to the petitioner, this Court is inclined to dispose of the Writ Petition, directing the respondents to pay the amount due to the petitioner within a period of six (6) weeks from the date of receipt of a copy of this order, failing which the petitioner is entitled to interest at 6%

per annum from the date of Writ Petition till the date of realization.

4. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, Interlocutory Applications pending, if any, shall stand closed.
