This Writ Petition is filed under Article 226 of Constitution of India for the following relief/s:-

“…to issue a writ, order or direction more particularly one in nature of MANDAMUS declaring the Notice of Sale of Immovable Property dated 26.12.2024 issued by the 5th respondent in E.P.No.1437/915/04/ Tirupathi/2023 in ARC No. 346/SOD/Tirupathi/2023 as illegal, ultra-vires, against to the principles of natural justice and contrary to law apart from being violative of Article 300A of the Constitution of India and consequentially set aside the same in the interest of justice and pass such other order or orders...”

2. The present writ petition is filed challenging the impugned notice dated 26.12.2024 issued under Rule 52(11)(e) and (16) of the Andhra Pradesh Cooperative Societies Rules, 1964. Wherein and whereby, the 5th respondent issued the notice to conduct auction for realization of the loan amount.

3. Learned counsel for the 6th respondent submits that already the petitioner has deposited an amount of Rs.20,00,000/- (Rupees Twenty Lakhs) and only Rs.5,00,000/-(Rupees Five Lakhs) is due. The auction was also postponed. Hence, requested to close the writ petition.

4. Recording the above submissions, the present Writ Petition is closed. However, if at all the petitioner is aggrieved, he is at liberty to file fresh writ petition. There shall be no order as to costs.

As a sequel thereto, miscellaneous Petitions pending, if any, shall stand closed.
