THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO.538 OF 2025 ORDER:-
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A3 and A4, seeking regular bail, in Crime No.321 of 2024 of Punganur Urban Police Station, Chittoor District.
2. A case has been registered against the petitioners herein and others for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).
3. Case of the prosecution, in brief, is that, on 16.07.2024, on receipt of credible information, the Sub-Inspector of Police, along with his staff and mediators, proceeded to a house bearing D.No.29-320, Bhagathsingh Colony, Punganur town and found the accused in possession of 59.4Kgs of Ganja. The contraband was seized under the cover of mediators report.
4. Heard. Perused the record.
5. Petitioners herein were arrested on 16.07.2024 and since then they are in judicial remand. The quantity of Ganja allegedly seized from the possession of the accused is 59.4Kgs. Learned Assistant Public Prosecutor submitted that investigation in the present crime has been completed and charge sheet was also laid and the same was taken on file as NSC No.32 of 2024.
6. In view of the fact that investigation is completed and charge sheet was also filed, this Court is inclined to grant bail to the petitioners/A3 and A4 on the following conditions.
i) The petitioners/A3 and A4 shall be released on bail on their executing personal bond for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the learned I Additional Judicial Magistrate of First Class, Punganur.
ii) On release, the petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet.
iii) Petitioners/A3 and A4 shall not go beyond the jurisdiction of Chittoor district, Andhra Pradesh State, without leave of the trial Court and they shall make available their location through mobile phones by pairing them with the mobile phone of the Investigating Officer round the clock.
