THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO.549 OF 2025 ORDER:-

This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A4 to A6, seeking regular bail, in Crime No.220 of

2024 of I Town Police Station, Vizianagaram District.

2. A case has been registered against the petitioners herein and others for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

3. Case of the prosecution, in brief, is that, on 02.05.2024, on receipt of credible information, the Sub-Inspector of Police along with his staff and mediators rushed to Employment Office, Bank Colony and found the accused in possession of 18Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report.

4. Heard. Perused the record.

5. On perusal of the material on record goes to show that on 02.05.2024, the police arrested A1 and A2 and seized 18 Kgs of Ganja from their possession. Basing on the confessional statement of A1 and A2, names of the petitioners herein/A4 to A6 are arrayed as accused in the present crime. On 06.11.2024, the petitioners herein were produced in execution of P.T. Warrant. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed and charge sheet is not filed for want of inventory.

6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/A4 to A6 on the following conditions.

i) The petitioners/A4 to A6 shall be released on bail on their executing personal bonds for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the learned I Additional District and Sessions Judge-cum-Special Judge for Trial of Offences under NDPS Act, Vizianagaram.

ii) On release, the petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet.

iii) Petitioners/A4 to A6 shall not go beyond the jurisdiction of Vizianagaram district, Andhra Pradesh State, without leave of the trial Court and they shall make available their location through mobile phones by pairing them with the mobile phone of the Investigating Officer round the clock.
