This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner/accused, seeking regular bail, in Crime No.555 of 2024 of Pendurthy Police Station, registered for the offences punishable under Sections 376 and 417 IPC.
2. It is a case of sexual intercourse with the victim by the accused on the pretext of love and marriage and thereby, cheating the defacto complainant.
3. Heard. Perused the record.
4. A perusal of the material on record goes to show that the petitioner herein, on the pretext of marring the defacto complainant, had gone physical with her from January, 2024. It has been stated by the defacto complainant that in the month of August 2024, the petitioner herein stated that he is already married and the said fact has been known to the defacto complainant. Despite the said fact, the defacto complainant, being a major, had gone physical with the petitioner herein. Moreover, the petitioner herein was arrested on 26.11.2024 and since then he has been languishing in jail. It is submitted by the learned Assistant Public Prosecutor that major portion of the investigation has been completed.
