CRIMINAL PETITION NO.277 OF 2025 ORDER:-
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail, in Crime No.87 of 2024 of Salur Rural Police Station, Parvathipuram District, registered for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).
2. Case of the prosecution, in brief, is that, on 08.08.2024, on receipt of credible information, the Sub-Inspector of Police, along with his staff and mediators, rushed to Baguvalasa village and found the accused in possession of 87.29Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report.

4. Petitioner herein was arrested on 08.08.2024 and since then he has been languishing in jail. The quantity of Ganja allegedly seized from the possession of the accused is 87.29Kgs. Learned Assistant Public Prosecutor submitted that investigation has been completed and the charge sheet could not be filed for want of inventory and there are no antecedents against the petitioner herein.
5. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/A1 on the following conditions.
i) The petitioner/A1 shall be released on bail on his executing personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned Special Judge for Trial of Cases under NDPS Act-
cum-I Additional Sessions Judge, Vizianagaram.
ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet.
iii) Petitioner herein/A1 shall not go beyond the jurisdiction of Parvathipuram district, Andhra Pradesh State, without leave of the trial Court and he shall make available his location through mobile phone by pairing it with the mobile phone of the Investigating Officer round the clock.
