CRIMINAL PETITION NO.554 OF 2025 ORDER:-
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A4 and A5, seeking regular bail, in Crime No.457 of
2024 of Anakapalli Town Police Station, Anakapalli District.
2. A case has been registered a the petitioners herein and others for the offences punishable under Sections 20(b)(ii)(B) read with 8(c), 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).
3. Case of the prosecution, in brief, is that, on 10.12.2024, at about 16.00 hours, on credible information, the Sub-Inspector of Police along with his staff and mediators, rushed to goods shed road junction, Anakapalli Town and found the accused in possession of 12KGs of Ganja. The contraband along with other material was seized under cover of a mediators report.
4. Heard. Perused the record.
5. The petitioners are in judicial custody since 10.12.2024. The quantity of Ganja allegedly seized from the possession of the accused is 12Kgs, which is not a commercial quantity. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/A4 and A5 on the following conditions.
i) The petitioners/A4 and A5 shall be released on bail on their executing personal bond for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the learned I Additional District & Sessions Judge- Special Judge for Trial of Offences under NDPS Act, Visakhapatnam.
ii) On release, the petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet.
iii) petitioners/A4 and A5 shall not go beyond the jurisdiction of Anakapalli district, Andhra Pradesh State, without leave of the Special Court and they shall make available their location through mobile phones by pairing them with the mobile phone of the Investigating Officer round the clock.
