CRIMINAL PETITION NO.652 OF 2025 ORDER:-
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A2 to A4, seeking regular bail, in Crime No.188 of 2024 of Therlam Police Station, Vizianagaram District, registered for the offence punishable under Section 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. Case of the prosecution, in brief, is that, on 19.12.2024, the accused were caught in possession of 18.2 Kgs of Ganja at water tank, near Bharth Petrol Bunk, SH-004 Road, Rangappavalasa Village. The contraband, along with other material, was seized under cover of a mediators report. The accused were arrested and got remanded to judicial custody.
3. Heard. Perused the record.
4. The petitioners are in judicial custody since 19.12.2024. The quantity of Ganja allegedly seized from the possession of the accused is 18.2 Kgs, which is not a commercial quantity. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed and there are no antecedents against the petitioners herein.
5. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/A2 to A4 on the following conditions.
i) The petitioners/A2 to A4 shall be released on bail on their executing personal bond for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the learned Principal Junior Civil Judge-cum-Judicial Magistrate of First Class, Bobbili, Vizianagaram District.
ii) On release, the petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Sunday between 10.00 am and 01.00 pm, till filing of the charge sheet.
iii) Petitioners/A2 to A4 shall not go beyond the jurisdiction of Vizianagaram district, Andhra Pradesh State, without leave of the trial Court and they shall make available their location through mobile phones by pairing them with the mobile phone of the Investigating Officer round the clock.
