Order:

This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A2, A3, A5 and A6, seeking regular bail, in Crime No.217 of 2024 of Nandyal II Town Police Station, Nandyal district.

2. A case has been registered against the petitioners herein and others for the offences punishable under Sections 115(2), 118(1) and 109 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’).

3. Case of the prosecution, in brief, is that, on 25.12.2024, at about 20.40 hours, A1 to A9 attacked the de facto complainant and beat him with sticks, stones and bricks with an intention to kill him and caused bleeding injuries.

4. Heard. Perused the record.

5. A perusal of the material on record goes to show that in view of the disputes between the de facto complainant and the accused a quarrel ensued amongst them. Pursuant to that, on the date of incident i.e., on 25.12.2024, all the accused are alleged to have gone to the house of the de facto complainant and beat him with sticks, stones and bricks. Petitioners herein were arrested on 26.12.2024 and since then they are in judicial remand for more than 40 days. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed.

6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/A2, A3, A5 and A6 on the following conditions.

i) The petitioners/A2, A3, A5 and A6 shall be released on bail on their executing personal bonds for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Nandyal.

ii) On release, the petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet.

7. Accordingly, the Criminal Petition is allowed.
