2. ELEVATED AS JUDGE The Court made the following Order:
This Writ Petitionis filed, under Article 226 of the Constitution of India, seeking the following relief:
“….to issue an appropriate the Writ or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents in issuing auction notice dated 15-6-2016 for conducting auction for the land in R.S.No.445/1, 2, 3 to an extent to Ac.2-69 cents, Pedhaguneru village, Mudinepalli Mandal, Krishna District, as illegall, arbitrary and violation of article 14, 21 constitution of India and consequently set aside the auction notice dated 15-6-2016 of the 3rd respondent to extent of the land in R.S.No.445/1, 2, 3 to an extent to Ac.2.69 cents, Pedhaguneru village, Mudinepalli Mandal, Krishna District….”
2. This Court, vide order, dated 27.06.2016, has granted interim order in WPMP.No.25259 of 2016 as follows:
“Subject to the petitioner paying a sum of Rs.10,000/- (Rupees ten thousand only) before the date of auction and further paying the balance amount of arrears of lease, within a period of 12 weeks thereafter, there shall be stay of auction in so far as the land in R.S.No.445/1, 2, 3 to an extent of Acs.2.69 cents situated at Pedhaguneru Village, Mudinepalli Mandal, Krishna District, for a period of 12 weeks.”
3. Today, when the matter is taken up for hearing, none appeared for the petitioner.
4. Heard Mr.P.Srinivas, learned Assistant Government Pleader for Endowments, for respondent Nos.1, 2 and 4 as well as Ms.Pulipati Radhika, learned Standing Counsel for respondent No.3.
5. On hearing, learned Standing Counsel submits that the petitioner has not complied with the order of this Court dated 27.06.2016. Further, the petitioner has surrendered the subject lands in the year 2018. Since then, the respondents have been continuously conducting auctions. She further submits that the respondents recently conducted an auction for the subject lands for the period 2024-2025 to 2026-2027, and a copy of the auction document has also been filed before this Court. Therefore, learned Standing Counsel
7. As a sequel, miscellaneous applications pending, if any, shall stand closed.
