Order:

This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking regular bail, in Crime No.51 of 2024 of G. Madugula Police Station, Alluri Sitharama Raju district.

2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

3. Case of the prosecution, in brief, is that, on 15.11.2024, at about 09.00 hours, on credible information, the Assistant Sub- Inspector of Police, G. Madugula Police Station, along with his staff and mediators, proceeded to Nurmathi village Junction and found one person in possession and illegal transportation of 200 Kgs of Ganja in Mahindra Commander Jeep bearing registration No.AP 39 GK 4609. The contraband along with jeep and other material was seized under cover of a mediators report and a case has been registered against the accused. A1 was arrested on 15.11.2024, A2 and A3 were arrested on 27.11.2024 and A4 is absconding.

5. A perusal of the material on record goes to show that 200 Kgs of ganja was seized from the possession of accused, which is a huge commercial quantity. It is submitted by the learned Assistant Public Prosecutor that investigation is not yet completed and A4 is to be arrested. This is the second bail application filed by the petitioner herein and the earlier bail application filed by him was dismissed by this Court on 02.01.2025. There are no changed circumstances for granting bail to the petitioner herein.

6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A3.

7. Accordingly, the Criminal Petition is dismissed.
