ORDER:
The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“….to issue an order writ or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondent no.5 by conducting auction on 23.07.2015 at 3.00 pm of the 5th respondent devasthanam lands in Survey No.439/1 to an extent of Ac.2.56 cents situated at Pottempadu Village Muthukur Mandal, SPSR Nellore District and land in Survey No.1344 to an extent of Ac.2.00 cents situated at Iskapalem Village, Venkatachalam Mandal SPSR Nellore District without any notice to the petitioners as illegal, arbitrary opposed to the established principles of law and are in violation of principles of natural justice and consequently direct the respondents to follow the due process of law and pass…..”
2. As seen from the proceeding sheet, this Court on 24.07.2015 while issuing ‘Notice before admission’, has granted the following interim order:-
“… Having regard to the earlier orders of this Court, by way of an interim order, liberty is granted to the respondents to conduct auction as proposed, but the auction proceedings shall not be finalized. If the petitioners are in possession of the subject lands, they shall not be displaced until further orders. The petitioners are also permitted to participate in the action, but their participation does not forfeit their rights as claimed in the writ petition…”
3. Heard Mr T.Manoj Kumar, learned counsel appearing on behalf of Mr V.Roopesh Kumar Reddy, learned counsel for the petitioners and the learned Government Pleader for Endowments appearing for the respondents.
4. On hearing, learned Government Pleader submits that as per the interim orders of this Court, dated 24.07.2015, the auction was conducted and survives in the present Writ Petition for adjudication and it may be closed.
5. Recording the submission of learned Government Pleader, this Writ Petition is closed. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
