The petitioner has filed the present writ petition seeking a direction to the respondents to accord permission to opt for UGC, 1996 pay scale to the post of Lecturer in Education with effect from 09.05.2000. The petitioner was appointed on 09.05.2000 for a post of Lecturer. The petitioner submitted an application for extension of UGC pay scale which was rejected by the 1st respondent. The respondents have in their order of rejection stated that the petitioner ought to have made a representation by exercising his option for extension of UGC pay scale, 1996 within three months from the date of orders. The case of the petitioner was rejected as his representation was made after a lapse of eight years. That apart, it is stated that UGC pay scale, 1996 was not extended to school education department.

2. Heard learned counsel for the petitioner and learned Government Pleader for Higher Education.

3. Learned counsel for the petitioner submits that the petitioner was working as a Lecturer in a Government College and his service would come under Higher Education.

4. It is submitted by the learned Government Pleader for Higher Education that during the pendency of the writ petition, the petitioner attained the age of superannuation on 31.08.2024 and the petitioner retired as a Deputy Director (KGBV) in the office of State Project Director, Samagra Shiksha, Andhra Pradesh.

5. Recording the submissions of the learned Government Pleader, the grievance of the petitioner cannot be adjudicated by this Court after his retirement. However, it is left open to the petitioner to submit his representation to the concerned department and seek extension of the UGC pay scale, 1996. The concerned department shall also consider the case of the petitioner on merits and pass necessary orders within six (06) weeks from the date of receipt of the representation.

6. Accordingly, the Writ Petition is disposed of. There shall be no orders as to costs.

Miscellaneous applications, pending if any, shall stand closed.
