Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not considering the petitioners representation dated 19-02-2026 for promotion to the post of Anganwadi Worker at Anganwadi Centre, Malepadu-ll, ICDS Project, Muddanuru, Erraguntia Mandal, Y.S.R. Kadapa District, and in proposing to issue a Notification to fill up the said post by direct recruitment, as illegal, arbitrary, unconstitutional, and contrary to G.O.Rt.No.102 dated 28-03-2011 and Memo NO.5771/K3/2006 dated 05-01-2012, and consequently direct the respondents to consider the petitioners case for promotion to the post of Anganwadi Worker at the said Centre and to pass

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondents not to fill up the vacant post of Anganwadi Worker at Anganwadi Centre at Malepadu-ll Centre pending disposal of the above writ petition and to pass

The Court made the following Order:

The Writ Petition is filed under Article 226 of the Constitution of India is filed by the petitioner declaring the inaction of the respondents in not considering the representation/ application made by the petitioner on 19.02.2026 for promotion to the post of Anganwadi Worker at Anganwadi Centre, Malepadu-II, ICDS Project, Muddanuru, Erraguntla Mandal, YSR Kadapa District.

2. Learned counsel for the petitioner submits that the petitioner was appointed as Anganwadi helper at Malepadu-II, ICDS Project, Muddanuru, Erraguntla Mandal, YSR Kadapa District on 08.07.2022. One Ch.Sagunamma, who is Anganwadi Worker was retired from service on 31.03.2023 and the petitioner is handling the entire centre on her own, and as such, she is directly eligible and entitled for the post of Anganwadi Worker. Hence, she made a representation/ application in terms of G.O.Ms.No.102. Surprisingly, respondents without considering the petitioner’s application, proceeding with the notification for filling up the said post. Hence, the present Writ Petition.

Learned Assistant Government Pleader appearing on behalf of the respondents on instructions submit that as per the amended Rules more specifically G.O.Ms.No.5 DWCDA&SC, dated 13.03.2026 accorded revised guidelines for promotion of Anganwadi Helpers to Anganwadi Workers, a minimum of 5 years of service as Anganwadi Helper is required.

Considering the rival submissions made by learned counsel for the petitioner and learned Assistant Government Pleader, without going into the merits of the case, this Court is inclined to dispose of the Writ Petition directing the respondents to consider the petitioner’s representation 19.02.2026 and pass appropriate orders, in terms of the Rules in vogue and communicate the same to the petitioner.

5. With the above direction, this Writ Petition is disposed of.

There shall be no order as to costs.

Interlocutory applications, if any, pending shall stand closed.
