WP 13123/2020

APHC010201552020 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI [3458]

(Special Original Jurisdiction)

THURSDAY, THE SIXTEENTH DAY OF APRIL TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA WRIT PETITION NO: 13123 OF 2020 Between:

1. S MT. M. LAKSHMI NARASAMMA,, W/O. M. THIKKA SWAMY AGE 48 YEAR AGRICULTURIST, H.NO. 20/100-1, SV SUBBA REDDY NAGAR, PATHIKONDA, KURNOOL DISTRICT.

...PETITIONER AND

1. T HE STATE OF ANDHRA PRADESH, REVENUE DEPARMENT, SECRETARIAT, AMARAVATHI, REP BY ITS SECRETARY.

2. T HE DISTRICT COLLECTOR, KURNOOL, KURNOOL DISTRICT.

3. T HE REVENUE DIVISIONAL OFFICER, ADONI, KURNOOL DISTRICT.

4. T HE TAHSILDAR, PATHIKONDA, KURNOOL DISTRICT.

...RESPONDENT(S):

Counsel for the Petitioner: 1. BUTTA VIJAYA BHASKER Counsel for the Respondent(S):

1. GP FOR REVENUE The Court made the following order:

Heard Sri Butta Vijaya Bhasker, learned counsel for the petitioner and Sri M.Chandra Sekhar, learned Assistant Government Pleader for Revenue appearing for respondents.

2. The grievance of the petitioner in the instant writ petition is against the action of the respondents in issuing house site pattas in respect of the land in an extent of Ac.2.00 cents in Sy.No.203 situated at Pathikonda Village and Mandal, Kurnool District in favour of the beneficiaries identified under „Navaratnalu Pedalandariki Illu‟ Scheme.

3. Today, when the matter is taken up for consideration, learned Assistant Government Pleader for Revenue has placed before the Court a copy of the written instructions received from the 4th respondent-Tahsildar dated 07.04.2026. A perusal of the same would reflect that the entire extent of Ac.16.10 cents in Sy.No.203, including Sy.No.203/3, is classified in the revenue records as Government poramboke, more precisely “Kunta” (pond). It is further stated that the land is not private patta land. It is stated that the claim of the petitioner is neither recorded in the Records of Rights nor supported by any valid assignment patta granted by the competent authority in favour of the petitioner.

4. It is further contended by the 4th respondent that entries in the Online Adangal would not confer any title in favour of the petitioner.

5. Learned counsel for the petitioner submits that the respondents have issued a D-form patta in respect of the subject land as long ago as 20.04.2004. In pursuance thereof, pattadar passbooks were issued and entries were also made in the Webland Adangal.

6. Having regard to the same, the respondents cannot contend that the subject land is classified as “Kunta” and that the petitioner has no right or title. 7. Having regard to the contentions advanced, this Court deems it appropriate to dispose of the Writ Petition with a direction to the respondents not to dispossess the petitioner from the subject property without any authority of law.

8. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
