Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declare the action of the respondents in withholding amounts for work done even after completion of work and finalization of Bills payable to the petitioner in relation to the works i.e.. Levelling work of Land Development Project in Community Lands, (i) in Aravapalli Gram Panchayat, Repalle Mandal, Bapatia the amount of Rs.2,67,000/- vide Work I.D. 070925210009170823, (ii) in Chennupallivaripalem Gram Panchayat, Repalle Mandal, Bapatia District for the remaining amount of Rs.2,47,000/- vide Work ID070925218015170486, as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondent authorities to release the amounts with interest @ 24per p.a. for the pending bills, forthwith for the above said works executed by the petitioner and pass

Heard Sri V. Surya Kiran Kumar, learned counsel for the petitioner; Sri P. Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj, for respondents 1 to 5 and 8, and Sri Hruthik, learned counsel representing Sri M. Sudhir, learned standing counsel for respondents 6 and 7.
The above writ petition was filed to declare the action of the respondents in not releasing the amount of Rs.5,14,000/- (Rs.2,67,000/- + Rs.2,47,000/-) payable to the petitioner in relation to the works i.e., levelling work of Land Development Project in Community Lands in (1) Aravapalli Gram Panchayat, Repalle Mandal, Bapatla District and ii) Chennupallivaripalem Gram Panchayat, Repalle Mandal, Bapatla District, vide work IDs 070925210009170823 and 070925218015170486, as illegal and arbitrary.
The petitioner‟s case is that Respondents 6 and 7 Gram Panchayats passed resolutions dated 20.11.2020 and 22.11.2019, respectively and awarded the work of „Land Levelling in Development of Housing colony under Land Development Project in Community Lands‟. The petitioner completed the works vide the aforementioned work IDs. However, the Gram Panchayats have not released the amount so far.
A counter affidavit was filed on behalf of respondents 6 and 7. In para No.4, it was pleaded that the petitioner has not executed the work covered under work ID No.070925210009170823, in Aravapalli Gram Panchayat, Repalle Mandal, Bapatla District.
