WRIT PETITION NO: 29674/2023
For the Appellants/Petitioners: B V S Chalapati Rao
For the Respondents: Arun Showri G, GP FOR GENERAL ADMINISTRATION, GP FOR COOPERATION
A writ petition may be dismissed as withdrawn when the counsel for the petitioners seeks permission from the court to withdraw the matter, resulting in the closure of all associated miscellaneous petitions.
Headnote:The petitioners approached the court under Article 226 of the Constitution of India seeking a writ of mandamus to declare the action of the 4th respondent illegal for not dissolving the managing committee of the 5th respondent society under Sec. 21(6)(a)(b)(c) of The Andhra Pradesh Mutually Aided Co-operative Societies Act, 1995. The petitioners further sought the appointment of an Ad-hoc committee under Sec. 23(3) and the conduct of an Annual General Meeting under Sec. 24(3) of the said Act. The primary issue was whether the managing committee of the respondent society was disqualified and should be dissolved. However, the court did not adjudicate on the merits of the case as the petitioners' counsel sought permission to withdraw the petition. Accordingly, the Writ Petition is dismissed as withdrawn.
