IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
D Ramesh, J
S VALLI BASHA – Appellant
Versus
The State of Andhra Pradesh – Respondent
WRIT PETITION NO: 17778/2024

Advocates:
For the Appellants/Petitioners: P Nagendra Reddy
For the Respondents: GP For Services I

Administrative authorities must consider the findings of a competent criminal court, particularly an acquittal, when determining disciplinary penalties such as withholding pension, to avoid arbitrary and illegal actions.

Headnote:The petitioner challenged the action of the State of Andhra Pradesh under Article 226 of the Constitution of India, specifically G.O.Ms.No.24 dated 22-05-2024, which withheld his entire pension and ordered recovery of Rs.1,96,613/-. The petitioner had previously been acquitted of criminal charges in C.C.No.262 of 2010 by the Judicial Magistrate of First Class, Nandyal, and a previous punishment order had been set aside by the Andhra Pradesh Administrative Tribunal. The court found that the impugned order was issued without considering the findings of the competent criminal court. The primary issue is whether the punishment of withholding pension is arbitrary when the petitioner has been acquitted of the related criminal charges. The court reasoned that since the issue had already been adjudicated by a competent court in C.C.No.262 of 2010, the administrative authority should consider these findings during a review process to ensure justice. the Writ Petition is disposed of granting liberty to the petitioner to file a review application before Respondent No.1 against the impugned orders dated 22.05.2024 within a period of one month from the date of receipt of a copy of this order.
