Versus
THE STATE OF ANDHRA PRADESH – Respondent
WRIT PETITION NO: 2213/2025

For the Respondents: GP FOR HOME

A writ petition for the issuance of an arms license is liable to be disposed of if the competent authority has already considered and rejected the application on valid grounds, such as the existence of a pending criminal case.

Headnote:The petitioner filed a petition under Article 226 of the Constitution of India seeking a Writ of Mandamus to compel the respondents to consider an application for a new arms license for a pistol, citing violations of Articles 14 and 21 of the Constitution of India, the Arms Act, 1959, and the Arms Rules, 2016. The court found that the application had already been considered and rejected by the Superintendent of Police on 24.02.2025 due to a pending criminal case against the petitioner. The central issue was whether the respondents failed to act upon the petitioner's application for an arms license. The court observed that the administrative process had been completed and the application was rejected based on a police report highlighting the petitioner's criminal history. Accordingly, the Writ Petition is disposed of.
