Singampalli Siva Kumar – Appellant
Versus

CIVIL REVISION PETITION NO: 1414/2026
For the Appellants/Petitioners: Satya Sreenivasa Rao K
For the Respondents:
In matters concerning the visitation rights of a parent to a minor child, the court may direct the trial court to dispose of pending applications expeditiously, deviating from the general rule against fixing time-bound schedules for lower courts.
Headnote:The petitioner approached the court under Article 227 of the Constitution of India seeking a direction to the trial court to dispose of an interlocutory application (I.A. No. 404 of 2024) regarding visitation rights for a minor child. The application had remained pending for two years without disposal. The court observed that while it generally refrains from fixing time-bound schedules for lower courts, exceptions exist for specific circumstances. The primary issue was whether the trial court should be directed to resolve the pending application for visitation rights within a fixed timeframe. The court reasoned that since the matter pertains to the visitation rights of a parent to a minor child and has been delayed significantly, it warrants an expedited resolution. this Civil Revision Case is disposed of directing the trial Court to dispose of I.A.No.404 of 2024 in G.W.O.P.No.17 of 2023 on the file Principal District Judge, Vizianagaram, as expeditiously as possible, preferably within a period of three (03) weeks from the date of receipt of a copy of this Order.

No.404 of 2024 in G.W.O.P. No.17 of 2023, and consequently direct the learned Court below to dispose of the said I.A. within a time frame as may be fixed by this Honble Court (b) Pending such disposal, this Honble Court may be pleased to grant interim visitation rights to the Petitioner-father, permitting him to meet the minor child, namely Singampalli Durga Saras Chandrika, on such terms as this Honble Court deems fit, including on alternate Sundays, during school holidays, festivals and on the birthday of the minor child (c) Pass

The Court made the following:
ORDER:
The present Civil Revision Case is filed seeking a direction to the trial Court to dispose of I.A.No.404 of 2024 in G.W.O.P.No.17 of 2023 on the file of Principal District Judge, Vizianagaram, filed by the petitioner seeking visiting rights to see her minor daughter by name Singampalli Durga Saras Chandrika, aged about 9 ½ years.
The Hon’ble Apex Court held that in an ordinary course, the Court should refrain from fixing a time bound schedule for disposal of cases pending before any other Courts. Of course, there must be exceptions and where they are clearly defined they must be given effect. The interlocutory application 404 is filed for visiting rights in the year 2024. Despite lapse of two years, the said application has not been disposed of by the trial Court.
As this is matter pertains to visiting rights, considering the prayer of the petitioner and circumstances involved in this case, this case is disposed of directing the trial Court to dispose of I.A.No.404 of 2024 in G.W.O.P.No.17 of 2023 on the file Principal District Judge, Vizianagaram, as expeditiously as possible, preferably within a period of three (03) weeks from the date of receipt of a copy of this Order.
With the above direction, this Civil Revision Case is disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
