The government is statutorily obligated to constitute the regular governing body of the Medical Council following the completion of elections and Gazette notification, as mandated by the Andhra Pradesh Medical Practitioners Registration Act, 1968.

Headnote:The matter pertains to the Andhra Pradesh Medical Practitioners Registration Act, 1968, specifically Section 3(2)(b). The petitioners, having been elected as members of the Medical Council and notified via Gazette, sought a direction for the constitution of the new Executive Body, as the respondent authority had permitted an Adhoc Committee to continue discharging statutory duties despite the election results. The primary issue was whether the respondent authority was mandated to constitute the regular governing body of the Medical Council following the completion of elections. The court observed that the competent authority is required to constitute and notify the governing body as per Section 3 of the Act, leading to an interim direction to complete the exercise within two weeks. The writ petition is disposed of as the regular Medical Council was constituted via G.O.Rt.No.404 dated 07.05.2026.

ORDER

1. The claim of the petitioners is that, petitioners are the elected members of Respondent No.2/Medical Council, pursuant to the elections held on 08.02.2026. Consequent to the election, Respondent No.1 declared and published the elected members vide Gazette dated 10.02.2026. Even after publication of Gazette, notifying the members in respect of Respondent No.2 Council, but for the reasons best known to Respondent No.1, so far, Respondent No.1 did not constitute the Medical Council and permitting the Adhoc Committee through the Registrar, and discharging the statutory duties of Respondent No.2. Having no other option, the elected members filed the present writ petition seeking direction against Respondent No.1 for constitution of new Executive Body for medical Council under Section 3(2)(b) of the A.P. Medical Practitioners Registration Act, 1968.

2. On 21.04.2026, this Court passed an interim order, which reads as follows:

“Heard the learned counsel for the petitioners and the learned Standing Counsel for respondent No.2.

The claim of the petitioner in the present writ petition is that even though elections were completed and elected members to the new governing body for respondent No.2-Council, but for the reasons best known to the respondent No.1, so far the governing body to the respondent No.2-Council was not notified by the respondent No.1 who is competent to constitute and notify the same as per Section 3 of the Andhra Pradesh Medical Practitioners Registration Act, 1968.

Learned Government Pleader furnished written instructions dated 20.04.2026 issued by respondent No.1, wherein it is stated that the respondents are taking steps for constitution of new governing body to the respondentNo.2-Medical Council and would be constituted at the earliest.

Considering the submissions made by the learned counsel for the petitioner and the learned Standing Counsel for respondent No.2, there shall be an interim direction directing respondent No.1 to complete the entire exercise of constitution of respondent No.2- Council, within a period of two weeks.”

During hearing, learned counsel for Respondent No.2/Medical Council furnished Memo No.321763/C1/2026 dated 07.05.2026, stating that the Government has issued orders constituting the Regular Medical Council as Andhra Pradesh Medical Council with 25 Members under the Andhra Pradesh Medical Practitioners Registration Act, 1968 vide G.O.Rt.No.404 Health, Medical & Family Welfare (C1) Department dated 07.05.2026. He further submits that, in view of constitution of regular Medical Council, no further orders are necessary.

Considering the submissions made by both the counsel and upon perusing the material available on record, more particularly, Memo No.321763/C1/2026 dated 07.05.2026 and G.O.Rt.No.404 Health, Medical & Family Welfare (C1) Department dated 07.05.2026, it appears that Respondent No.1 constituted regular Medical Council for Andhra Pradesh State medical Council under Andhra Pradesh Medical Practitioners Registration Act, 1968. Therefore, in view of constitution of regular Medical Council, as contemplated under Andhra Pradesh Medical Practitioners Registration Act, 1968, the relief claimed by the petitioner is already addressed, as such no further orders are necessary to be passed in this writ petition

5. By observing the same, writ petition is disposed of.

6. Consequently, miscellaneous applications pending if any, shall also stand closed.
