Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the Respondents in respect of release of an amount of Rs.50,57,000/- (Fifty Lakhs and Fifty Seven Thousands only) to the petitioner in respect of execution of work by the petitioner i.e., construction of Indoor Stadium at Nuzuveedu, Krishna District (presently Eluru District), pursuant to Agreement No.12A/CE/APSHCL (AP)/NZD/2014- 2015 dated 18.02.2015, and Supplementary Agreement No.01/5A/CE/APSHCL(AP)/NZD/2014-2015 dated 30-03-2023, as illegal, irregular, irrational, violation of Government Orders besides violation of Principles of Natural Justice and consequently direct the respondents to pay the above said due amounts to the petitioner along with interest @ 24percent per annum immediately in respect of the above said work executed by the petitioner, in the interest of justice and to pass

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to release the necessary funds and to make payment of an amount of Rs.50,57,000/- (Fifty Lakhs and Fifty Seven Thousands only) to the petitioner along with interest 24% per annum, in respect of execution of work by the petitioner i.e., construction of Indoor Stadium at Nuzuveedu, Krishna District (presently Eluru District), pursuant to Agreement No.12A/CE/APSH CL (AP)/NZD/2014-2015 dated 18.02.2015, and Supplementary Agreement No.01/5A/CE/APSHCL(AP)/NZD/2014-2015 dated; 30-03-2023, in the interest of jusitce, during the pendency of the writ petition and to pass

The Court made the following Order:

Instant Writ Petition has been filed by the petitioner under Article 226 of the Constitution of India is filed for the following relief:

“.... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the Respondents in respect of release of an amount of Rs.50,57,000/- (Fifty Lakhs and Fifty Seven Thousands only) to the petitioner in respect of execution of work by the petitioner i.e., construction of Indoor Stadium at Nuzuveedu, Krishna District (presently Eluru District), pursuant to Agreement No.12A/CE/APSHCL (AP)/NZD/2014- 2015 dated 18.02.2015, and Supplementary Agreement No.01/5A/CE/APSHCL(AP)/NZD/2014-2015 dated 30-03-2023, as illegal, irregular, irrational, violation of Government Orders besides violation of Principles of Natural Justice and consequently direct the respondents to pay the above said due amounts to the petitioner along with interest @ 24percent per annum immediately in respect of the above said work executed by the petitioner and pass such other order …”.

2. Sum and substance of the writ petition is that the petitioner challenged the inaction of the respondents in not releasing the amounts, even after completion of the entire works entrusted to him.

3. Heard learned counsel for the petitioner and learned Assistant Government Pleader for respondents.

4. Learned counsel for the petitioner, while reiterating the averments made in the writ affidavit, submits that in view of the non-release of the admitted amounts, the petitioner is facing multifarious problems, physically and fiscally. Hence, he submits that the release of the amounts is just and essential.

5. On the other hand, learned Assistant Government Pleader, places a copy of the written instructions dated 03.05.2026 issued by the District Head Housing, Krishna District and submits that six months’ time may be granted for paying the admitted amount of Rs.50,56,895/- to the petitioner.
