Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue an appropriate order, writ or direction, one in the nature of Writ of Mandamus declaring the high handed action of the respondents in interfering with my peaceful possession and enjoyment of land admeasuring an extent of Ac.0-88 cents in Sy.No.96/3 Mulapalli Village, Siddavatam Mandal of Kadapa, Y S R Kadapa District adjacent to my lands admeasuring, Ac. 1-41 cents vide Patta No. 182 namely Ac.0-38 cents in Sy. No.14/1 Ac.0-32 cents in Sy.No. 58/2 Ac.0-23cents in Sy.No. 59/1 Ac.0-27 cents Sy.59/3 and Ac.0-21 cents in Sy.No.60 i.e., Acl- 41 cents in Mulapalli Village, Siddhavatam Mandal, Kadapa District, despite proceedings conforming my right and possession for over a period of 30 years vide File No. REV-ESEC0C.M/56/2025-JA (SAN)-JA(E4)-KDPCO dated 28-06- 2025, as being illegal, arbitrary and unjust and violative of articles 14,19 and 21, 300-A of the Constitution of India besides being violative of principles of equity and natural justice and consequently set aside the impugned notice dated 17-04-2026 v/c/eB/278/2026 and further direct the respondents not to interfere with my peaceful possession and enjoyment of land admeasuring an extent of Ac.0-88 cents in Sy.No.96/3 Mulapalli Village, Siddavatam Mandal of Kadapa, Y S R Kadapa District,adjacent to my lands admeasuring, Ac.1- 41cents vide Patta No.182 namely Ac.0-38 cents in Sy. No.14/1 Ac.0-32 cents in Sy.No. 58/2 Ac.0-23cents in Sy.No. 59/1 Ac.0-27 cents Sy.59/3 and Ac.0- 21 cents in Sy.No.60 i.e., Acl-41 cents in Mulapalli Village, Siddhavatam Mandal, Kadapa Districtand grant further consequential orders or such other orders as this Honble Court deems fit in the interests of justice having regard to the facts and circumstances of the case.

The Court made the following ORDER:

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents.

2. This Writ Petition is filed questioning the notice issued by the 4th respondent dated 17.04.2026, under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905, alleging that the petitioner has encroached upon the land to an extent of Ac.0.45 cents of the subject land out of Ac.1.00 cents in Sy.No.96/3 of Mulapalli Village, Siddavatam Mandal of YSR Kadapa District, which is otherwise a Government land, by covering with the muskmelon crop.

The learned counsel for the petitioner submits that the said impugned notice of the 4th respondent date 17.04.2026 is contrary to the endorsement issued by the 4th respondent 28.06.2025, in respect of the land in an extent of Ac.0.88 cents in Sy.No.96/3 of Mulapalli Village, Siddavatam Mandal of YSR Kadapa District.

4. On the other hand, the learned Assistant Government Pleader appearing for the respondents submits that it is only a notice and if the petitioner submits his explanation to it, the same will be considered by the respondent authority concerned, following the due procedure.

In view of the above said facts and circumstances, the petitioner is permitted to submit his explanation, by enclosing all the necessary documents in support of his claim to the above said notice dated 17.04.2026, within four (04) weeks from the date of receipt of copy of this Order.
