Petition under Article 226 of the Constitution of India praying that in
the circumstances stated in the affidavit filed therewith, the High Court
may be pleased to issue a Writ order or direction more particularly one in
the nature of Writ of Mandamus, declaring the inaction of Respondent
Nos.3 to 8 in restoring the irrigation canal stream/ flow by removing the
encroachments at Sy.No.73-6 of Vengamambapuram Village,
Balayapalle Mandal, Tirupathi District, which is flowing to my fields
situated in Sy.Nos.59-9 and 59-10 of Vengamambapuram Village,
Balayapalle Mandal, Tirupathi District as being illegal, arbitrary and
violation of Articles 14, 19, 21 and 300-A of the Constitution of India and
consequently direct Respondent Nos.3 to 8 to restore the irrigation canal
stream/ flow by removing the encroachments at Sy.No.73-6 of
Vengamambapuram Village, Balayapalle Mandal, Tirupathi District and

The Court made the following:
ORDER:
Questioning the action of the respondents in not restoring the
irrigation canal stream/flow by removing the encroachments at Sy.No.73-
6 of Vengamambapuram Village, Balayapalle Mandal, Tirupathi District,
which is flowing to his fields in Sy.No.59-9 & 59-10, as illegal and
arbitrary, the present writ petition is filed.
2. Heard Sri Malireddy Gowtham, learned counsel for the petitioner
and Sri S.Satish Kumar, learned Assistant Government Pleader for
Irrigation for the respondents.
3. Learned counsel for the petitioner, while reiterating the contents of
the writ affidavit would contend that despite bringing it to the notice of the
respondents concerned about the illegal encroachments so made on the
subject irrigation canal by way of representation dated 19.12.2025, they
are not acting upon the same. He would further contend that it would
suffice for the time being if a direction is given to the respondents to take
steps in accordance with law, accordingly, prayed to pass appropriate
orders.
