Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to consider the representation of the petitioner to accord notional seniority to the petitioner and pass

The Court made the following:

ORDER:

This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-

“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declare the action of the respondents in not according notional seniority and notional pay fixation to petitioners from the initial date of appointment as 05.04.2012 as notional seniority of the petitioner on par with his batch-mates as illegal, arbitrary and violative of constitutional remedies and consequently direct the respondents to fix notional seniority of petitioner w.e.f. 05.04.2012 on par with his batch-mates along with all consequential service benefitsand pass such other order.”

2. Heard learned counsel for the petitioner and learned counsel for the respondents.

3. Learned counsel for the petitioner submits that the petitioner submitted representations dated 03.02.2025, 15.02.2025 & 15.12.2025 to the respondents requesting for grant of notional seniority and consequential service benefits. But, the respondents did not consider the case of the petitioner. Hence, the writ petition.

4. On the other hand, learned Government Pleader for the respondents submits that the respondents would consider the representations of the petitioner and pass appropriate orders as early as possible.

Considering the submissions made by the learned counsel for all the parties and on perusal of the material placed on record, this Court inclined to dispose of the writ petition directing the respondent Nos.3 and 4 to consider the representation dated 15.12.2025 of the petitioner and pass appropriate orders, after providing opportunity of hearing to the petitioner in accordance with law, within a period of three (3) months from the date of receipt of copy of this Order.

6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel miscellaneous application, pending, if any, shall also stand closed.
