ORDER:

Assailing the correctness and legality of the order passed by the learned

Additional Civil Judge (Senior Division), Kadapa in I.A.No.4 of 2025 in O.S.No.74

of 2017, dated 03.02.2025, the present Civil Revision Petition has been filed.

2. The facts leading to filing of the present Civil Revision Petition is that the

petitioner is the plaintiff and the respondents are the defendants in a suit for

declaration of title and permanent injunction. The plaintiff filed I.A.No.4 of 2025

under Order VII Rule 14(3) of Civil Procedure Code (hereafter referred as CPC)

duly praying the Court to receive the document mentioned in the said petition and

mark the same as exhibit on behalf of the plaintiff on the ground that the said

document now sought to be received is an important piece of evidence to prove

the plaintiff’s claim and to disprove the defendants’ case and that the copy of the

said document was obtained recently. It was further pleaded that the delay in

filing the said document was neither willful nor due to negligence. The

respondents/defendants opposed the said application/petition denying the

allegations and prayed to dismiss the petition contending that the proposed

document was already declared as an invalid document by the earlier Court in

the earlier suit and consequently Exs.A1 and A2 in the said suit were also held to

be invalid documents and yet the petitioner approached the Court without

disclosing the said facts. Upon hearing both the parties and considering the

material available on record, the trial Court dismissed the said interlocutory

application. Assailing the same, the present civil revision petition has been filed.

3. Heard Syam Sundar Reddy, learned counsel for the petitioner and

Ms.Sodum Anvesha, learned counsel for the respondents.

4. Learned counsel for the petitioner, while reiterating the contents of the

affidavit filed before the trial Court and the grounds raised in revision before this

Court, submitted that the Court below failed to see the purport of Order VII Rule

14 (3) of CPC. The document now sought to be received by the Court was

already mentioned in the plaint; however, the same was not filed along with the

plaint as the same was not available with the plaintiff and a certified copy thereof

was obtained recen
