Petition under Article 226 of the Constitution of India praying that in the

circumstances stated in the affidavit filed therewith, the High Court may be

pleased to issue a Writ, Order or direction particularly one in the nature of

Writ of Mandamus to declaring the inaction on the part of the respondents

herein not releasing and paying the bill amounts worth of Rs.8,77,295/- with

interest 6PERCENT per annum under the grant of MGNRGS for Execution

and Construction of Grama panchayath building as illegal arbitrary and

violative of Article 14, 16 AND 21 of the Constitution of India and consequently

to direct the respondents to release and pay the bill amounts worth of Rs.

8,77,295/- with intrest 6 PERCENT per annum under the grant of MGNRGS

to the petitioner forthwith and pass

Heard Sri Sri Bokka Satyanarayana, learned counsel for the petitioner

and Sri P. Rajesh Kumar, learned Assistant Government Pleader for

Panchayat Raj and Rural Development and Finance for respondents 1 to 5

and 7 and learned standing counsel for respondent No.6.

2. The above writ petition was filed to declare the action of the

respondents in not releasing an amount of Rs.8,77,295/- payable to the

petitioner for the work executed i.e. „Construction of Gram Panchayat Office

Building at Ganijerla (V) of Chintalapudi (M)‟, as illegal and arbitrary.

3. Today, when the matter is taken up, learned Assistant Government

Pleader for Panchayat Raj and Rural Development submitted the instructions

of the Executive Engineer, PR Division, Jangareddygudem.

4. A perusal of the instructions would disclose that the petitioner has

executed the aforementioned work and the amount payable is Rs.10,40,111/-

+ Rs.2,64,179/- (G.P Portion) totaling to Rs.13,04,290/-, out of which

Rs.3,82,142/- was paid and the balance amount payable to the petitioner is

Rs.9,22,148/-. The written instructions are made part of the record.

5. Learned counsel for the petitioner endorses the same.

6. Thus, as seen from the instructions there is no dispute regarding the

execution of works and the petitioner‟s entitlement for Rs.9,22,148/-. Since the
