State of AP – Respondent
WRIT PETITION NO: 17481/2023
For the Appellants/Petitioners: Adapa Ramya Sahithi Naidu
For the Respondents: GP for Services III, Indus Law Firm
A writ petition challenging administrative decisions regarding notional seniority in public service may be dismissed when the petitioners formally request to withdraw the proceedings.
Headnote:The petitioners filed a writ petition under Article 226 of the Constitution of India challenging Government Memo No.ESE01-AEDNODAE (MISC)/25/2020-PROG.III dated 13.06.2022 and Proceedings in Rc.No.975/Al/DAE/2014 dated 02.05.2023. The challenge was based on the grounds that extending notional seniority to a respondent in the cadres of Assistant Project Officer and Assistant Director was illegal, arbitrary, and violative of Articles 14 and 16 of the Constitution of India. The court was tasked with determining the legality of the seniority benefits granted to the unofficial respondent over the petitioners. However, before the court could delve into the merits of the case, the petitioners sought permission to withdraw the writ petition. Accordingly, the present writ petition is dismissed as withdrawn.
