WRIT PETITION NO: 24979/2025
For the Appellants/Petitioners: B. Abhay Siddhanth Mootha
For the Respondents: GP for Revenue, V V N Narasimham, GP for Social Welfare, D Dorababu
A writ petition challenging the disqualification from a government tender may be dismissed if the petitioner seeks to withdraw the matter before adjudication on merits.
Headnote:The petitioner approached the court under Article 226 of the Constitution of India challenging an order dated 25.07.2025 issued by the respondents. The order disqualified the petitioner from a tender for the supply of perishable items to 7040 children of 11 Dr. B.R. Ambedkar Gurukulams in Prakasam District. The petitioner contended that the disqualification was arbitrary, illegal, and contrary to the principles of natural justice, and that the tender was awarded to other respondents who did not fulfill the eligibility criteria. The primary issue was whether the disqualification of the petitioner and the subsequent award of the tender to other parties were legally sustainable and compliant with the tender conditions. However, before the court could adjudicate on the merits of the case, the counsel for the petitioner sought permission to withdraw the petition. Accordingly, the Writ Petition is dismissed as withdrawn.
